Exterior Enhancements hereby warrants that all labor performed and materials installed by Exterior Enhancements will be free from defects in workmanship for a period of 120 months from the Completion Date ("Warranty Period"). This Warranty covers only workmanship defects related to installed work performed by Exterior Enhancements .
Remedy
If a covered defect occurs within the Warranty Period, Exterior Enhancements will repair or replace the defective work at no cost to the Customer. Exterior Enhancements must be notified in writing within 10 business days of the defect's discovery. The Customer's sole remedy under this Warranty shall be the repair or replacement of defective work.
Exclusions
This Warranty does not cover:
- Damage caused by acts of God, including but not limited to: storms, hurricanes, tornadoes, floods, earthquakes, lightning, hail, or ice damming.
- Damage caused by fire, explosion, or other casualty events.
- Damage caused by vandalism, misuse, negligence, or improper maintenance by the Customer or any third party.
- Damage caused by structural movement, defective materials or structures not installed by Exterior Enhancements , or changes to the building's usage.
- Normal wear and tear, fading, or cosmetic issues that do not affect performance,
- Damage caused by pests, animals, or plant growth.
- Any work not performed by Exterior Enhancements or unauthorized modifications to Exterior Enhancements 's work.
Nullification
This Warranty shall be null and void if:
- The Customer fails to pay the full contract price, including any agreed-upon change orders, in accordance with the terms and conditions of the contract.
- The Customer fails to perform required maintenance, including but not limited to annual inspections by Exterior Enhancements starting three years after installation and continuing annually thereafter.
- The Customer or any third party attempts to repair or modify Exterior Enhancements 's work without prior written authorization from Exterior Enhancements .
- The Customer fails to provide timely written notice of any defects as required by this warranty.
- Any of the circumstances listed in the Exclusions section of this Warranty occur, including but not limited to damage caused by acts of God, fire, vandalism, structural movement, or pests.
Limitations
- Exterior Enhancements 's total liability under this Warranty shall not exceed the original contract price for the work performed.
- Exterior Enhancements shall not be liable for any consequential, incidental, or special damages arising from the work performed or this Warranty.
- This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
Transfer of Warranty
This Warranty may be transferred one time only to a subsequent owner of the property. To effect a transfer, the new owner must notify Exterior Enhancements in writing within 10 business days of the property transfer and pay a transfer fee of $250 within 10 business days of the property transfer.
Entire Agreement
This Warranty constitutes the entire agreement between Exterior Enhancements and the Customer regarding warranty coverage and supersedes all prior warranties, representations, or agreements, whether oral or written.
Claims Process
To make a claim under this Warranty, the Customer must:
- Notify Exterior Enhancements in writing within 10 business days of discovering the alleged defect.
- Provide Exterior Enhancements with a reasonable opportunity to inspect the alleged defect.
- Allow Exterior Enhancements to perform any repairs deemed necessary under this Limited Warranty.
